New Tier 1 Rules

Since April 1st 2008 in India and Feb 28th in UK, people applying for HSMP Visa or further leave to remain - FLR - will have to apply under the new Tier 1 Points Based System - PBS. While the core categories in which points accumulated remain the same, there are other changes that might affect your application.

 

  • The validity for the initial visa will be for 3 years instead of the 2 years as under HSMP Visa
  • The provision under which MBA students from top universities could get a visa has been removed
  • The quantity of funds to be maintained has been defined by the Home Office
  • Biometrics is compulsory

 

In addition to this, an application applying for Tier 1 Visa would now be required to get 95 points instead of the earlier 75 points. The additional points are allotted for English Proficiency and maintaining funds.

In addition there is transition arrangement for people who fall under one of the following categories

 

  • Already in UK on a HSMP Visa and need to apply for extension under the Tier 1 system
  • Already in the UK on the Tier 1 visa and need to apply for an extension under the same category
  • Already in the UK and need to apply for a Tier 1 Visa
  • Got HSMP approval and need to apply for Entry Clearance
